The council is urging authorities to review his case, warning that actions viewed as arbitrary may erode public trust in Nigeria's democratic institutions.
In a statement issued on Tuesday and signed by Secretary-General Malam Nafi’u Baba-Ahmad, the council emphasized the necessity of adhering to due process in El-Rufai’s detention.
They underscored that every Nigerian, regardless of status or political affiliation, is entitled to fundamental rights and should be presumed innocent until proven guilty.
The statement, titled “Urgent Call for Adherence to Rule of Law in the Continued Detention of Mallam Nasir Ahmed El-Rufa’i,” highlighted the importance of the rule of law being applied equally to all citizens.
While the council does not condone any form of criminality, it insists that the pursuit of justice must remain fair and consistent with legal procedures.
The council expressed particular concern over the circumstances surrounding El-Rufai's detention and the difficulties he has encountered in meeting bail conditions.
They reiterated that he is entitled to his rights and should be treated fairly within the judicial system.
The SCSN called on authorities to operate strictly within constitutional confines, ensuring that due process is observed throughout the legal proceedings.
They warned against actions that could be perceived as politically motivated persecution, emphasizing that Nigeria’s unity relies on the credibility of its institutions.
Moreover, the council stated, “Justice must not only be done but must be manifestly seen to be done,” advocating for impartiality in the application of justice as a safeguard for national cohesion and sustainable development.
El-Rufai's detention stems from his arrest in February 2026 amid investigations into alleged financial misconduct during his tenure as governor. He has faced various proceedings involving security and anti-corruption agencies.
In April, a Federal High Court granted him conditional bail concerning allegations of abuse of office, money laundering, and fraud.
However, El-Rufai remains in custody due to complications in fulfilling his bail conditions and other ongoing legal matters.
The Sharia Council's statement reflects a broader call for justice and fairness, aiming to protect the rights of citizens while fostering peaceful coexistence in Nigeria.
