Court Upholds Denial of Bail for Ex-Governor El-Rufai Amid Financial Allegations

The Court of Appeal in Kaduna has dismissed an appeal by former Kaduna State Governor, Nasir El-Rufai, seeking bail after a lower court denied his application. The unanimous decision from the three-member appellate panel emphasized that El-Rufai failed to present new facts or special circumstances justifying the court's interference.

The ruling, delivered by Justice Onyekachi Aja Otisi, reaffirmed the previous decision made by the Kaduna State High Court on June 10, 2026. El-Rufai is currently facing prosecution by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) for alleged financial misconduct during his tenure from 2015 to 2023.

Despite his denials of wrongdoing, El-Rufai's continued detention has raised questions about the integrity of the judicial process. The appellate court noted that the lower court's refusal of bail was based on the evidence presented by both parties.

The prosecution argued that El-Rufai's public comments, including those made during a televised interview, suggested potential interference with justice. The court highlighted concerns over his remarks regarding defending his political legacy and an admission of wiretapping related to the National Security Adviser.

Justice Otisi clarified that the court's decision did not imply guilt, emphasizing that El-Rufai remains presumed innocent until proven otherwise.

He acknowledged the former governor's participation in the controversial interview but maintained that the trial court's assessment was sound.

El-Rufai contended that his return to custody after attending his mother's burial proved he was not a flight risk.

However, the prosecution countered that he was under close surveillance during the event.

The appellate court dismissed El-Rufai's claims regarding the burial, stating that the absence of supporting documents weakened his case.

Justice Otisi remarked that courts cannot rely on speculation when making decisions, particularly in criminal matters.

The court also approved an expedited hearing for El-Rufai's trial, emphasizing the need for timely proceedings while he remains in custody.

The judges expressed confidence that the prosecution was diligently pursuing the case.

In a concurring opinion, Justice Abimbola Obaseki-Adejumo agreed that no compelling facts had emerged to alter the bail decision. She emphasized that the situation remained unchanged since his initial application.

Justice Lateef Ganiyu also concurred, noting that the lack of supporting documentation in El-Rufai's bail application undermined his arguments.

The court's ruling underscores the legal challenges faced by the former governor as he navigates serious allegations against his administration.
