The court found the defendants guilty on five counts brought by the Economic and Financial Crimes Commission (EFCC), including conspiracy, unlawful possession, and attempted exportation of minerals without proper authorization.
Each defendant received a 25-year sentence for every count, with the option to pay a fine of ₦10 million per count. The sentences are effective from the date of their arrest, and all mineral resources involved were ordered to be forfeited to the Federal Government.
The pair was arrested alongside a third suspect, Gao Pei Yu, who remains at large.
According to the charges filed on May 28, 2025, the defendants allegedly conspired to defraud the Federal Government of revenue by attempting to export strategic minerals without legal clearance. The prosecution outlined that these offenses were committed in Lagos, violating the Miscellaneous Offences Act of 1983.
The EFCC further accused them of unlawfully possessing various mineral resources intended for export. The minerals included mica varieties such as Muscovite and Lepidolite, lithium-bearing ores like Spodumene and Petalite, as well as other minerals linked to copper deposits.
After carefully reviewing the evidence, Justice Aluko concluded that the EFCC had successfully proven its case beyond a reasonable doubt, leading to the conviction of both defendants.
This ruling marks a significant step in Nigeria's efforts to combat illegal mining and resource exploitation, underscoring the need for strict adherence to laws governing mineral exports.
